Welcome to Creative AI Writer (“the Platform,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of “creativeaiwriter.com” (the “Website”) and all associated services, including any applications, software, products, and content provided by AI Creations (ABN 24545074491) (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms.

If you do not agree, do not access or use our Services.

1. Eligibility and Accounts

  1. Minimum Age Requirement: You must be at least 8 years old to use our Services. By accessing or using the Platform, you represent and warrant that you are 8 years of age or older.

  2. Account Creation: You must create an account to access certain features of the Platform. Please provide accurate, current, and complete information and keep it updated.

  3. Account Responsibility: You are responsible for taking reasonable measures to protect your account credentials from unauthorized access. Each individual is allowed one account. Creating multiple accounts is prohibited and may lead to account suspension or termination at our discretion.

2. Description of Services

  1. Purpose: Creative AI Writer is a writing and editing platform that uses various AI models to assist authors in drafting or refining written content (“User Content”).

  2. AI Models: AI models used in the Services are provided by third-party services. While we strive to offer reliable suggestions, we cannot guarantee the accuracy or completeness of AI-generated outputs. AI models are constantly evolving and may sometimes produce inaccurate, biased, or inappropriate outputs. It is your responsibility to critically evaluate AI-generated content and ensure its accuracy, suitability, and compliance with all applicable laws and ethical standards before use. We are not responsible for the consequences of your reliance on AI-generated content.

  3. User Ownership: You retain ownership of any User Content you create, subject to these Terms.

  4. Service Availability and Evolution: We may, at our sole discretion and without prior notice, modify, suspend, or discontinue any aspect of the Services, including but not limited to features, AI models used, and credit allocations. Where possible, we will strive to provide reasonable notice of significant changes.

3. Subscription Model, Credits, and Trials

  1. Subscription Plans: We offer monthly subscription plans that provide a certain number of credits (“Credits”) for AI usage.

  2. Credit Renewal: Credits renew each month for active subscriptions. Unused credits roll over for three months.

  3. Trial Accounts: We may provide new users with a small number of trial Credits at our discretion. These trial Credits expire if not used within three months of account creation.

  4. Cancellation:

    • Effective Date: Subscription cancellations take effect at the end of the current billing period.

    • Remaining Credits: After cancellation, remaining Credits are accessible for at least three months, after which they may be forfeited.

    • Billing Failures: If a recurring payment fails, new Credits will not be applied until the billing issue is resolved.

    • Refunds: Refunds are generally not offered for partially used subscription periods. However, in exceptional circumstances, refund requests may be reviewed.

  5. Rate Limiting: Excessive usage or activity that negatively impacts platform performance may result in rate limiting or other restrictions.

4. Fair Use and Prohibited Conduct

  1. General Compliance: You agree to use the Services in compliance with all applicable laws and regulations.

  2. Prohibited Activities: You must not:

    • Compromise anyone’s safety
    • Incite violence or hateful behavior
    • Violate privacy or identity rights
    • Create psychologically or emotionally harmful content
    • Engage in fraudulent, abusive, or predatory practices
    • Abuse our Platform (e.g., unauthorized system access, overloading servers, bypassing security, using automated scripts in violation of these Terms)
    • Generate sexually explicit content
    • Reproduce, duplicate, sell, or exploit any portion of the Services without express written permission

  3. Enforcement: We reserve the right to suspend or terminate any account that violates these Terms or engages in harmful, objectionable, or unlawful behavior.

5. User Content and Data Usage

  1. Ownership: You retain full ownership of any text, creative works, or other content (“User Content”) you create through the Services.

  2. Limited License: By submitting User Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to store, process, and transmit your User Content solely as necessary to provide the Services.

  3. No AI Model Training: We do not use your User Content for training our AI models.

  4. AI Output Review: AI-generated text is automatically produced. You are responsible for reviewing and determining its use.

6. Payment and Billing

  1. Fees: Subscription fees are charged on a recurring monthly basis unless specified otherwise.
  2. Payment Information: Payment details are managed by Stripe. We do not store credit card details (we only store a reference to your Stripe information).
  3. Trial Period: If a trial period is offered, trial Credits are valid for three months.
  4. Refunds: Refunds are not provided except in exceptional circumstances at our discretion.

7. Suspension and Termination

  1. Violation of Terms: Accounts violating these Terms or applicable laws may be suspended or terminated.

  2. User Termination: You may cancel your subscription via the settings page.

  3. Access to Content: After cancellation, access to User Content remains available for at least three months.

  4. Dormant Accounts: Long-term inactivity may result in account removal. We will attempt to contact you before closure.

8. Disclaimers and Limitations of Liability

  1. No Warranty: The Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind.
  2. Limitation of Liability: To the fullest extent permitted by law, AI Creations (ABN 24545074491) is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Services.
  3. AI-Generated Content: AI-generated content may be inaccurate or inappropriate. You assume full responsibility for its use.

9. Indemnification

You agree to defend, indemnify, and hold harmless AI Creations, its affiliates, officers, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the Services or violation of these Terms.

10. Modifications to the Terms

We reserve the right to modify these Terms at any time. If material changes occur, we will provide reasonable notice, such as by posting a notice on our Website or emailing users. Continued use of the Services after the effective date of any changes constitutes acceptance of the revised Terms.

11. Governing Law and Dispute Resolution

  1. Governing Law: These Terms are governed by the laws of Australia.

  2. Dispute Resolution: Any disputes shall be subject to the exclusive jurisdiction of the courts in Australia.
